1. Definitions

• You / Donor: Any individual or organization using the Platform.
• We / Us / Our / Platform: Daan Mitra (platform operator/facilitator).
• Platform / Website: The website and services offered at https://daanmitrafoundation.com/.
• Beneficiary / Campaigner: NGO, trust, society, institution, or individual supported through the Platform.
• Campaign: Any fundraising or donation drive hosted on the Platform.
• Services: Facilitation of donations, campaign listing, campaign promotion tools, and donor communication/receipts where applicable.

2. Scope of Services

Daan Mitra is a technology platform that helps donors discover campaigns and donate securely. We aim to make giving easy and transparent. Where a Campaign’s requirement is fulfilled, paused, or changed due to ground realities, and where permitted, donations may be redirected to a similar cause/category to ensure timely charitable impact.

3. Eligibility

You confirm that you are at least 18 years of age and competent to contract under Indian law. Donations from outside India may be subject to additional compliance requirements and payment partner rules (including FCRA where applicable).

4. Platform Role & Campaign Responsibility

Daan Mitra acts as a facilitator of charitable giving and provides a platform for Campaigners to list causes. While we may conduct basic checks, Campaigners are solely responsible for the accuracy of campaign information, utilization of funds, and compliance with applicable laws. Donors are encouraged to review details before donating.

5. Donations & Payment Terms

• Payments are processed via third-party payment gateways and are governed by their respective terms and policies.
• For recurring/monthly donations, you consent to periodic charges until cancelled as per the relevant policy.
• For receipts and acknowledgements, you must provide accurate details (name, email, etc.) at the time of donation.

6. Tax Exemption & Compliance

Eligible donations may qualify for tax benefits under applicable Indian laws (e.g., Section 80G) subject to statutory compliance. Issuance of tax receipts (if applicable) depends on the Campaigner/organization’s eligibility and the details you provide.

7. Crowdfunding Risk, No-Return & Legal Waiver

• Not an Investment: Donations are voluntary and charitable in nature. They do not create any ownership, return, or financial claim.
• No Outcome Guarantee: Outcomes depend on multiple external factors. Lack of expected results does not create a right to damages or refunds.
• Limited Liability: To the maximum extent permitted by law, our total liability for any claim arising from your use of the Platform shall not exceed the total amount you donated on the Platform in the preceding six (6) months.
• No Class Actions: You agree to bring claims only on an individual basis; class, collective, or representative actions are waived.
• Indemnity: You agree to indemnify and hold us harmless from claims arising out of your misuse of the Platform or breach of these Terms.

8. Refunds, Chargebacks & Cancellations

Refunds are limited to exceptional cases (e.g., duplicate transaction, clear gateway error) and processed as per our Refund & Return Policy. Chargebacks initiated without first contacting us may delay resolution. Recurring donations can generally be cancelled before the next billing cycle as per the monthly donation policy shown on the Platform.

9. AML/KYC, Prohibited Uses & Suspension

• We may conduct KYC/AML checks and request information to comply with law and payment partner requirements.
• Prohibited: illegal/fraudulent activity; misrepresentation; hate, violence, or discriminatory content; activities violating public policy.
• We may suspend or terminate access where we suspect fraud, non-compliance, or legal risk.

10. Intellectual Property

All content (text, graphics, images, logos, and software) on the Platform is owned by or licensed to Daan Mitra and/or its licensors. You may not use, reproduce, or distribute it without prior written permission.

11. Privacy & Data Protection

Your privacy is important to us. Please read our Privacy Policy to understand how we collect, use, and safeguard your data.

12. Third-Party Links & Services

The Platform may contain links to third-party sites/services. We are not responsible for their content, policies, or practices.

13. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, acts of government, network outages, etc.).

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts at Dehradun, Uttarakhand, India. Parties shall first attempt good-faith negotiations; failing which, disputes will be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator seated in Dehradun, conducted in English.

15. Changes to Terms

We may modify these Terms at any time. Updates will be posted on this page, and continued use of the Platform constitutes acceptance of the revised Terms.
